With a valid letter
- require extra compensation for an emotional support animal, which takes pet rent, pet deposits, and pet fees off the table under § 760.27(2)
- request information that discloses the diagnosis or the severity of the tenant's disability, or any medical records
- require a specific form or a notarized statement, or deny a request solely because the tenant did not use the provider's routine method
- refuse the request merely because the property advertises a no-pets policy, since the request is judged under the reasonable-accommodation standard in § 760.23(9)(b)

- request reliable information supporting the disability when the disability is not readily apparent, including a government disability determination, proof of disability benefits, or information from a licensed practitioner
- treat an out-of-state practitioner's information as unreliable unless that practitioner has provided in-person care or services to the tenant on at least one occasion
- ask for information about the specific need for each animal when a tenant requests more than one emotional support animal
- require proof of compliance with state and local licensing and vaccination requirements for the animal
- deny the accommodation on a direct-threat finding (the animal endangering the health or safety of other people, or threatening physical damage to what belongs to them), where no other accommodation can reduce or eliminate the threat
- hold the tenant liable for damage the animal does to the premises or to another person on the premises
The Florida rule: § 760.27 wrote the standard down
Created in 2020, § 760.27 says a provider’s letter must come from someone with personal knowledge of your disability, executed in the course of a real clinical relationship. It also criminalizes misrepresentation. The upside of a strict statute: a compliant Florida letter is unusually hard for a landlord to push back on.

About “ESA registration” in Florida
Florida settles the registry question in the statute rather than in guidance. Section 760.27(3)(c) says an emotional support animal registration of any kind (an identification card, a patch, a certificate, or a similar registration obtained from the Internet) is not by itself sufficient information to establish either a disability or a disability-related need for the animal. No Florida agency issues ESA credentials, and buying one adds nothing to a request. Section 817.265 adds the opposite of a benefit: knowingly providing fraudulent ESA documentation is a second-degree misdemeanor.

Are there penalties for misrepresenting an ESA in Florida?
Yes. § 760.27(3) makes knowingly falsifying a need a misdemeanor. It is one more reason the legitimate route, a real evaluation, is also the safe one.
Can a Miami condo association override my letter?
No. Associations are housing providers under both § 760.27 and the FHA, so their pet rules yield to valid documentation exactly as a landlord’s do.
Is an online ESA letter valid in Florida?
Yes. Florida layers its own fair housing law on top of the federal Fair Housing Act, and neither requires an in-person visit, what both require is a real evaluation by a provider licensed for Florida. A telehealth evaluation that ends in a signed letter meets that standard; a questionnaire that ends in a PDF does not.
