## The number everyone gets wrong

Belgrade rents 2,130 of its 4,852 occupied homes, 43.9 percent on the 2020–2024
American Community Survey five-year estimate, thirteen points above Montana's 30.8
percent.

Median gross rent is **$1,877**. That is the highest of any of Montana's twenty
largest municipalities: **above Bozeman's $1,717**, by $160, and more than two and
a half times Anaconda's $696 at the other end of the table.

It is worth stating plainly because the assumption runs the other way.
Bozeman is the city everyone names when Montana rents come up, and Bozeman
does hold a superlative: the highest renter share, at 55.3 percent. But on
price, its satellite eight miles up the road to the airport is more
expensive.

The 2024 Census estimate puts Belgrade at 12,741, eighth in the state. It
grew because Bozeman priced people out; it is now the most expensive rental
market among Montana's larger municipalities. Both of those things are true
at once, and the second one surprises people who have lived here for years.

## Why the price matters more here than elsewhere

Because Montana does not cap security deposits.

MCA Title 70, chapter 25, the residential security deposit chapter, regulates
what may be **deducted** from a deposit and how it must be **returned**. Read it
through and there is no maximum anywhere in it. No two-months rule. Nothing.

So the sum a Belgrade landlord may lawfully ask for is unconstrained by
statute, in the most expensive market in the state. A pet deposit at a
month's rent here is nearly $1,900. A deposit set at two months is $3,750
before anyone mentions an animal.

What the chapter gives back is control over the exit. MCA 70-25-201(1) lists what
may be deducted: damage, unpaid rent, late charges, utilities, lease penalties,
other money owing, and actual cleaning expenses including a reasonable charge for
the landlord's labour. And MCA 70-25-201(4):

> "A person may not deduct or withhold from the security deposit any amount for
> purposes other than those set forth in this section."

A closed list, on an uncapped sum. In Belgrade that provision is worth more, in
dollars, than in any other Montana city on this site.

## Two chapters, one deposit rule

Belgrade's rental stock splits between newer subdivision houses and
manufactured-home communities, and those are governed by different landlord-tenant
chapters. Tenants in the second often assume the ordinary rules do not reach them.

The deposit chapter is drafted to cover both. MCA 70-25-201(3)(b) sets its
cleaning-notice timetable by reference to notice "pursuant to **70-24-108 or
70-33-106**", and to a rental agreement already terminated "pursuant to
**70-24-427 or 70-33-427**."

Chapter 70-24 is the Residential Landlord and Tenant Act. Chapter 70-33 is the
mobile home lot chapter. The security deposit provisions in MCA 70-25-201:
including the closed list of deductions and the written-notice requirement before
any cleaning charge, operate against both.

That is as far as this page goes on the point: the deposit chapter reaches both
kinds of tenancy because its own text says so. The rest of chapter 70-33 has its
own rules about lot tenancies, and nothing here should be read as a claim about
them.

## Where the animal fits, and why it is an argument

Montana's route is indirect and it needs saying every time, because the obvious
citation is a trap.

MCA 49-4-214(2) bars requiring "extra compensation" for a **service animal**. MCA
49-4-203(2) then provides that "'Service animal' means a dog or miniature horse
individually trained to provide assistance to an individual with a disability. The
term does not include an emotional support animal."

So the pet deposit does not come off because a Montana sentence says so. It comes
off because MCA 49-2-305(4)(b) makes it an unlawful discriminatory practice to
discriminate because of disability "in the terms, conditions, or privileges of a
sale or rental," and the underlying duty in MCA 49-2-305(5)(a)(ii) is to make
"reasonable accommodations in rules, policies, practices, or services when the
accommodations may be necessary to allow the person equal opportunity to use and
enjoy a housing accommodation or property."

No animal named. No training required.

## Which raises the obvious question at these rents

If a landlord cannot charge a pet deposit, and Montana caps nothing, what
stops the ordinary deposit from simply going up by the same amount?

The answer is that 49-2-305(4)(b) measures by comparison rather than by size. If
the figure moved because of the animal, that movement is a distinction in the
rental's terms made because of a disability, whatever the line is called, and
whatever the going rate for deposits happens to be.

A comparison needs two figures, and only one of them is under your control.
So in Belgrade, more than almost anywhere: **ask for the rent and deposit in
writing before you disclose the animal.** A text message will do. It is an
ordinary request that no honest landlord refuses, and at $1,877 median rent
the number it produces is the most valuable thing in the file.

MCA 70-25-101(4) covers the other evasion: "a fee or charge for cleaning and
damages, no matter how designated, is presumed to be a security deposit." A charge
renamed is still a deposit, and still inside the 70-25-201 list.

## And the deadline, which is short

MCA 49-2-501(4)(a) requires a complaint to the Department of Labor and Industry
"within 180 days after the alleged unlawful discriminatory practice occurred or was
discovered," and MCA 49-2-501(5) makes dismissal of an untimely complaint
mandatory. The discovery wording helps where a deduction only surfaces after
move-out; it does not help a tenant who simply waited.

## The premise, which Montana gives you no help establishing

Every provision above protects a person with a disability for whom an
accommodation may be needed. Montana has enumerated no professions, built no
register, issued no certificate, and already written emotional support animals
out of its only animal definition. What is left is an examination.

Ask a clinician you already see. Someone who has treated you can speak to a
disability-related need from history rather than one appointment, at the cost of a
visit. Gallatin County's capacity has badly lagged its growth: waits of several
months are ordinary, new-patient lists close, and some practices decline housing
documentation as a matter of policy. Belgrade itself has very little of its own;
most of it means driving to Bozeman.

Where it is not, a licensed evaluation arranges the same examination
deliberately. A Montana-licensed clinician establishes whether a disability is
present and whether this animal accommodates it, then documents the finding or
explains that they cannot reach it. A guaranteed finding was reached before you
walked in.

At Montana's highest rents, with no statutory ceiling on the deposit and no
statutory fee bar to point at, that determination is not a formality. It is the
entire difference between a charge you can have removed and a charge you will pay.

## What Belgrade landlords can and cannot do

**Cannot:**
- May not refuse a reasonable accommodation in rules, policies, practices or services where it may be necessary to allow a disabled tenant equal opportunity to use and enjoy the housing: MCA 49-2-305(5)(a)(ii). A no-pets rule is a rule, and the accommodation is an exception to it.
- May not discriminate because of disability in the rental itself, in the terms, conditions or privileges of the tenancy, or in the services and facilities provided with it: MCA 49-2-305(4).
- May not make a disability inquiry of a prospective tenant for the purpose of discriminating, MCA 49-2-305(1)(c).
- May not relabel a cleaning-and-damages charge to escape the security-deposit chapter: MCA 70-25-101(4) presumes any such fee to be a security deposit "no matter how designated."
- May not deduct anything from a security deposit outside the closed list in MCA 70-25-201, and may not deduct cleaning charges at all until written notice has been given and the tenant has had 24 hours to do the cleaning.

**Can:**
- May still hold the tenant liable for damage the animal actually does, MCA 70-25-101(2) and 70-25-201(1) both reach it.
- Is not barred by any Montana statute from charging a pet fee as such: the fee falls away because the accommodation analysis under 49-2-305(5)(a)(ii) and the federal Fair Housing Act says it must, not because a Montana sentence says so.
